General conditions

These general conditions of sale (“General Conditions”) are governed by the Consumer Code (Legislative Decree no. 206/2005 and subsequent amendments) and by the regulations on electronic commerce (Legislative Decree no. 70/2003 and subsequent amendments) and apply exclusively to the remote sale via the web of the products (“Products”) present and displayed on the website www.carismatix.it (“Site”) and marketed by Carismatix Srl, with registered office in Altavilla Vicentina (VI) Via dei Laghi 24, VAT no. and Tax Code no. 04201310242 (“Company”).

How to purchase

The customer can only purchase the products present in the electronic catalogue www.carismatix.it at the time of placing the order. The purchase contract will be considered concluded between the Company and the customer upon receipt by the customer of the order confirmation email (“Order Confirmation”) sent by the Company to the email address provided by the customer. This Order Confirmation will summarise the selected Products, their prices (including shipping costs and any additional costs relating to additional services requested by the customer), the delivery address, the order number and any special conditions applicable to the individual order and determined following specific requests from the Customer. It is possible that, occasionally, the products offered may not be available. In this case, the Company undertakes to promptly notify the Customer. The Company has the right not to accept the order due to production and/or logistical needs. In this case, no liability may be attributed to the Company.

Prices

The price shown on the site at the time the order is sent applies to the Products. All prices indicated on the site are inclusive of VAT.

Payment Methods

Payment by the customer must be made at the time of placing the Order with the Company. The following payments are accepted:

• Bank transfer in advance to: Carismatix SrL IBAN: IT33K0200860350000106217019 , inserting the order number in the subject;
• Credit cards;
• Apple Pay, PayPal

The Company will not proceed with the shipment and delivery of the Products until the payment has been completed and credited. In the event of failure to complete the payment by the customer, the contract will be considered terminated.
Since these are indirect e-commerce operations assimilated to mail order sales (Presidential Decree No. 633/72), the Company is not subject to the obligation to issue an invoice or other receipt. The Company will issue an invoice for the material shipped only if requested by the Customer at the time of ordering. The information provided by the customer will be used to issue the invoice.

Delivery methods and costs

Delivery will be carried out by specialized carriers appointed by the Company. The Company can accept orders for delivery exclusively in Italian territory.
Upon delivery, the customer is required to check that the packaging is intact. In the event of visible defects, the Customer is required, under penalty of forfeiture of possible disputes or guarantees, to report the aforementioned anomalies on the transport document and to contact the Company immediately.
Delivery costs are charged to the Customer.

Here are the shipping costs:

ITALY:

• €5.90 for express shipping 24/48h for orders up to €29.90
• €7.90 for insured shipping
• Free for uninsured orders over €29.90
• Free for collection - by appointment - at our office in Via dei Laghi, 24 - 36077 Altavilla Vicentina (VI)

ABROAD:

• Austria, Belgium, Czech Republic, Denmark, France, Germany, Hungary, Iceland, Luxembourg, Poland, Portugal, Slovakia, Spain: €9.90 for orders up to €99.90, free for orders above that.
• Bulgaria, Croatia, Estonia, Latvia, Lithuania, Romania, Slovenia, Sweden: €19.90 for orders up to €99.90, €9.90 for orders above.
• Non-EU countries, always subject to charges.
• The amount is calculated when the country is selected.

GLS and FedEx shipments travel at the sole risk of the buyer. If you want the shipment to be fully covered against theft and breakage, insurance coverage is provided that guarantees the customer to receive a new package at no additional cost.

In the event that the Customer chooses uninsured shipping, the Company is in no way responsible for the material from the moment the packaged Products have been delivered to the courier. From that moment, the responsibility for the package is borne by the customer.

Right of withdrawal

If the Customer is a “Consumer”, as defined by the Consumer Code, he/she is entitled to the rights set forth in art. 52 et seq. of the Consumer Code, as amended by Legislative Decree no. 21 of 21/02/2014, and therefore the right to withdraw from the purchase contract for any reason, without explanation and without any penalty, in the manner specified below. The withdrawal may concern all Products purchased. The withdrawal period expires after 14 days from the day on which the Consumer acquires physical possession of the Products. The right of withdrawal is exercised by sending – before the expiry of the period indicated above – a withdrawal notice by email to the following address info@carismatix.it. Once the withdrawal notice has been received, the Company will communicate to the customer the instructions for returning the Products, which must take place within the following 14 days. The shipping costs relating to the return of the Products are borne by the customer; The Products in question and the organization of the shipment, until receipt in the Company's warehouse , are under the complete responsibility of the customer . The right of withdrawal is however subject to the following conditions: the right applies to the Products purchased in their entirety and still packaged inside the original package, as delivered by the Company to the carrier. It is not possible to exercise withdrawal only on part of the Products purchased. The sums paid for the purchase of the returned Products will be refunded once the return has been received. In the case of items purchased with free shipping, following the return the costs incurred by the Company for shipping and management equal to €6 will still be retained. The right of withdrawal lapses, due to the lack of the essential condition of integrity of the item (packaging and/or its contents), in cases where the Company ascertains the lack of the external packaging and/or the original internal packaging where existing and/or the absence of integral elements of the product and/or damage to the product for reasons other than its transport.

Processing of personal data

The customer's data is processed by the Company in accordance with the provisions of the legislation on the protection of personal data as specified in the information provided in the specific section on the website www.carismatix.it
